Matthews stated during Tuesday's sentence that the family wouldn't be housed together and that the Michigan Department of Corrections has suggested James and Ethan Crumbley won't be in the same facility due to their relationship. State jail 17 miles from Oxford High School holds Ethan. Jennifer Crumbley would go to the state's sole women's prison.

Both might have avoided the shooting with “tragically simple actions,” prosecutors argued, but they “failed to take any action when presented with the gravest of dangers.”

The sentencing document for James Crumbley stated that "his jail calls show a total lack of remorse" and that "he blames everyone but himself."

Multiple jail calls were taped with him making expletive-laced threats to the prosecutor, according to the document. In one call before trial, he stated, "Karen McDonald, you're going down," prosecutors alleged. They said he threatened vengeance in other calls.

In court filings, Mariell Lehman, James Crumbley's lawyer, stated that Crumbley's calls did not involve threats to physically harm the prosecutor but that he wanted McDonald to be barred from practicing law.

At his scenario, "It is clear Mr. Crumbley is venting to loved ones about his frustrations related to the lack of investigation done by the prosecution prior to authorizing charges," Lehman wrote. Seven of the 200 calls contained purported threatening words, and some requested for prayers for the families of the deceased.

Mark Chutkow, a lawyer who supervised Detroit's U.S. attorney's criminal division and is unrelated to the Crumbley cases, said Matthews must evaluate each parent separately at sentencing even if the circumstances are identical.

So "issues of threats, of obstruction, of lack of remorse are very important factors for her to consider when considering what an appropriate sentence is for the father," he said. "And these are pretty serious allegations." Attorney Shannon Smith has indicated that Jennifer Crumbley will appeal James Crumbley's verdict, but Lehman has not.
